These terms apply to all contracts between B A Media Group FZE LLC (the "Provider") and the customer regarding the provision of company address lists via adresslisten.kaufen.

2. Subject of the service

The Provider supplies deduplicated business data for the chosen industry and region, compiled from publicly accessible business and address directories, as a CSV file. No specific number of entries, completeness or timeliness is guaranteed, as this depends on the underlying sources.

3. Conclusion of contract

The contract is concluded upon submitting the order and completing payment via Stripe. The free sample function does not constitute a paid offer.

4. Prices and payment

The prices displayed at the time of ordering apply, plus statutory VAT. Payment is made via Stripe; the invoice is issued by Stripe.

5. Delivery

The service is digital. After receipt of payment the file is prepared, which may take a few minutes depending on scope. The customer receives a time-limited (24 hours) download link on the status page and by email.

6. Withdrawal and early expiry

Consumers have a right of withdrawal as set out in the withdrawal policy. For digital services the right of withdrawal expires upon full performance if the customer expressly consented to immediate commencement and confirmed knowledge of the loss of the right.

7. Use of the data

The delivered data is commercial B2B data. The customer is responsible for lawful use and observes in particular the requirements of the UWG and GDPR, e.g. for direct marketing. Reselling the raw data as a standalone data product is not permitted.

8. Liability

The Provider is liable without limitation for intent and gross negligence and under the Product Liability Act. For slight negligence the Provider is liable only for breach of material contractual obligations and limited to the foreseeable damage typical for the contract. No warranty is assumed for the accuracy of data from third-party sources.

9. Final provisions

The law of the Provider's seat applies, unless mandatory consumer protection provisions conflict. Should individual provisions be invalid, the remainder of the contract remains effective.
